NorthPeak Staffing – Recruitment Partnership Terms & Conditions

These Recruitment Partnership Terms & Conditions (“Terms”) govern the cooperation between NorthPeak Staffing (“Company”) and any hotel, restaurant, hospitality business, or other client (“Client”) using the recruitment and staffing services provided by NorthPeak Staffing.

By submitting a hiring request, accessing candidate profiles, using candidate dashboards, scheduling interviews, or otherwise engaging with NorthPeak Staffing services, the Client agrees to these Terms.

1. Scope of Services

NorthPeak Staffing provides recruitment and candidate sourcing services for hospitality businesses, including but not limited to:

  • Candidate sourcing
  • Pre-screening and interviews
  • CV and candidate presentation
  • Coordination of interviews
  • Recruitment support
  • Seasonal staffing assistance
  • Candidate communication and onboarding coordination

NorthPeak Staffing acts solely as a recruitment intermediary and is not the employer of introduced candidates unless explicitly agreed otherwise in writing.

2. Candidate Introduction

A candidate shall be considered officially introduced once the Client receives any of the following from NorthPeak Staffing:

  • Candidate CV
  • Candidate profile
  • Contact details
  • Interview arrangement
  • Candidate presentation through email, dashboard, ATS system, or shared recruitment platform

All introduced candidates remain subject to these Terms.

3. Placement Fees

Placement fees shall be agreed individually between NorthPeak Staffing and the Client unless otherwise specified in writing.

The placement fee becomes payable once:

  • the candidate signs an employment agreement with the Client, or
  • the candidate starts employment, trial work, or paid training with the Client.

Invoices are payable within 14 days unless agreed otherwise in writing.

Late payments may result in suspension of ongoing recruitment services.

4. Candidate Ownership & Non-Circumvention

All candidates introduced by NorthPeak Staffing remain protected candidates for a period of 12 months from the date of introduction.

The Client agrees not to:

  • hire introduced candidates outside of NorthPeak Staffing,
  • forward candidate profiles to third parties,
  • share candidate information externally,
  • bypass NorthPeak Staffing to avoid placement fees.

If the Client hires or engages an introduced candidate, directly or indirectly, during the protection period, the standard placement fee remains fully payable.

This clause also applies to affiliated businesses, partner hotels, management companies, and associated entities connected to the Client.

5. Replacement Policy

If a successfully placed candidate leaves the position within the first 14 days for justified reasons, NorthPeak Staffing may provide one replacement candidate at no additional placement fee.

Replacement guarantees do not apply in cases including but not limited to:

  • unpaid salary,
  • misleading job conditions,
  • breach of the employment agreement by the Client,
  • unsafe or inappropriate working conditions,
  • significant deviation from the agreed job description,
  • accommodation issues,
  • visa or legal employment issues caused by the Client.

NorthPeak Staffing reserves the right to evaluate each case individually.

6. Client Responsibilities

The Client agrees to:

  • provide accurate job descriptions,
  • communicate employment conditions transparently,
  • comply with applicable labor laws,
  • provide legal employment contracts,
  • ensure lawful working conditions,
  • respond to candidate communication within reasonable timeframes.

The Client remains solely responsible for all employment relationships and workplace obligations.

7. Candidate Dashboard & Shared Data

Clients may receive access to candidate dashboards, recruitment platforms, shared folders, or ATS systems operated by NorthPeak Staffing.

All candidate data is confidential and intended solely for internal recruitment purposes.

The Client may not:

  • copy candidate databases,
  • export candidate information,
  • distribute candidate profiles externally,
  • use candidate information for purposes unrelated to recruitment, cooperation with NorthPeak Staffing.

Access may be revoked at any time in case of misuse.

8. Confidentiality

Both parties agree to keep confidential all non-public business, recruitment, and candidate information obtained during cooperation.

This obligation continues after the termination of cooperation.

9. Data Protection & GDPR

NorthPeak Staffing processes candidate data in accordance with applicable GDPR and data protection regulations.

Candidate information shared with Clients may only be used for legitimate recruitment purposes related to open positions.

Clients are responsible for handling candidate data securely and in compliance with applicable privacy laws.

10. Limitation of Liability

NorthPeak Staffing makes reasonable efforts to evaluate and pre-screen candidates, but does not guarantee:

  • employee performance,
  • long-term retention,
  • future conduct,
  • suitability beyond the recruitment process.

Final hiring decisions remain solely the responsibility of the Client.

NorthPeak Staffing shall not be liable for indirect, consequential, or business losses arising from employment relationships between the Client and candidates.

11. Termination of Cooperation

Either party may terminate cooperation at any time in writing.

Termination does not affect:

  • outstanding invoices,
  • payment obligations,
  • candidate protection clauses,
  • confidentiality obligations,
  • candidates introduced before termination.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Czech Republic.

Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts of the Czech Republic in Brno.

13. Updates to Terms

NorthPeak Staffing reserves the right to update or modify these Terms at any time.

The latest version will always be available on NorthPeak Staffing's official website.

Continued cooperation after updates constitutes acceptance of the revised Terms.
